I Squatted Your .EU writes EUBrowser Loses UDRP – buy-sell.ie

isn’t buy and sell up 4 sale! my comment failed to submit over on that blog so here it tiz

the amount of inbound google searches to my blog for bebo.ie makes it clear to me, bebo is leaking at the till for these lost sheep, eubrowser can wag their tails behind them along with their irish hosting 365 friends who’s banner adorns their ad-fest pages. bebo.ie is directed to bebo.hu now! surely the inbound links off the h365 ad to http://www.hosting365.com could address the squatting issue, and take the HIGHER moral ground rather that the cheap publicity (non paid advertising?) that the ad now gives. see ipod.ie

    Hi Brian,
I had a look at buy-sell.ie and I was very disapointed to see that a broker got the domain after been taken away from eubrowser.ie. How is that possible? Did WIPO not take a decision about the case?
I think that it is completely ridiculous!
First of all, who dictates who deserves to have a domain name?. I registered my business name around a year ago with the CRO and I found out after a while that another 3 businesses in Ireland have the same name! There are over 16 business names in Ireland with the words”buy” “sell” in their business names. So who deserves to have the domain name?.
I’m really sorry for all this big corporations who obviously had no interest in the irish market for years and suddenly when someone else gets the domain they get into panic. If they don’t care, why should they deserve to have it?. Well, you now what? if I was WIPO I would tell them to F… O..
I think that this is another example of how small business or individuals have nothing to do against big corporations.
It looks to me that the case against eubrowser is based on the high number of domains they have not about the way the use them. But as far as I’m aware there are no limits on how many domains or business names you can purchase, are there?. So, if that’s the case is WIPO taking decisions based on the power of those organisations or on the rules in the first place?.
It is a bit of a mistery why eubrowser.ie bought so many domains, but at the same time they have not used those names to make money in any way. So I supose that we’ll have to wait and see what are they up to.
By the way, Brian I’m a bit dissapointed to see that after so many critics about squatting and about this eubrowser.ie guys you didn’t even bother to buy your own .ie domain. Are you another example of one of these organisations that just “don’t care” to spend €84.64 incl. VAT? Well, I hope that there are no many Brian Greene’s in Ireland. If there are, you might have a bit of competition and if they register the name before you… I think that you’ll be on trouble… so, tough!

PS. can we please look at the big picture and stop mooning?. If we want to criticise here are a couple of ideas: sedo.com, afternic.com, etc… Why WIPO allows that type of business in the first place?

    Cheers,

    Elora

    Elora,
    1. buyand sell do own it look at the iedr entry
    http://www.iedr.ie/cgi-bin/whois.cgi?whois=buy-sell.ie&Search.x=0&Search.y=0

    2. Julian Carter is B&S see http://www.iia.ie/member_detail.asp?memberid=2698

    3. does eubrowser not take the advert money for the ads shown? by my web logs false look ups of bebo.ie are worth a small fortune

    4. stop mooning? you moon, I’ll moan (record it and make a premium phone service out of it)

    5. yes you have a strong point running thought out your comment, the WIPO are bending over for the big boys, B&S were less interested before they put them self up for sale !!!!!!!! sale = company plus domain (no squatters) looks like a better deal.

    6. the website you provided with your comment is a) very similar to you email address, b) the website does not work,
it is the nature of WP to show you url, if your email is in fact real, it could be now exposed, if so contact me and I will remove it.

    7. re briangreene.ie €84.64 incl. VAT is high, i buy from Blacknight (much cheaper) I am also a public rep. in politics, have run for public office and under the rules of iedr have good claim to .ie. I have briangreene.com but while I could make cash on adverts for books by author on string theory i don’t

  4. Elora Says:

    Hi Brian,

Yes it would be great if you could remove my email address from your website. I don’t have my website up yet so I can not give you one at the moment.
I’m sorry if my comment about the .ie domain was a bit blunt. But it looks to me that there is no much interest from this companies about the .ie domain until it is too late. What would happen if instead of having lots of domains under their name, they only had a couple of them? Would the big boys still winning the case?. if CRO allows you to register such a big amount of business names, how can you prevent something like this to happen? they should be stopped once they resgister at the CRO. Instead, they have been getting the money of the registration. So I guess it was good enough for them.

PS. the moaning thing was not for you personally. I was just hopng to be able to talk about the source of the problem not about the end result so we could have a more constructive solution. But if you want to moan… enjoy :-)

email as uri fixed… moaning / mooning was me playing on the typo…
the real story is a loophole was abused big time and should be plugged. lets not diminish what eubrowser did, or deny that monies are not still pouring in… and hosting 365 have yet to comment (they dont have to, this is not a black list kangaroo court!) IEDR are supposed to MANAGE a managed ccTLD, the arguments may not be made from the finders keepers point of view.
IEDR should manage, and plug the loophole.

There’s coverage of the EUBrowser guys in today’s Sunday Times. I posted some extracts on my domain blog:
    http://www.isquattedyour.eu/2007/08/19/defending-the-indefensible-eubrowser-denies-cybersquatting/

As for the managed TLD argument – a domain registry can’t defend trademark holders rights directly. The onus is on the trademark holder to do so. I could have a legitimate claim to a domain name which would allow me to register it in the IE namespace, however that does not mean that there isn’t a trademark somewhere that I am breaching without being aware of it (though in the case of any of the IE disputes at WIPO the infringers would have been aware)
